Welcome to TownGuide. These Terms of Service (“Terms”) govern your access to and use of the TownGuide website, mobile applications, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

1. About TownGuide

TownGuide (“TownGuide,” “we,” “us,” or “our”) provides tools, content, and features designed to help users discover, explore, and engage with towns, places, and local experiences.

TownGuide is not responsible for any loss or damage resulting from unauthorized access to your account.

  • upload or share content that is harmful, misleading, defamatory, or offensive;

5. User Content

You may be able to submit, upload, or post content through the Services (“User Content”).

By submitting User Content, you:

  • grant TownGuide a non-exclusive, worldwide, royalty-free license to use, host, display, reproduce, and distribute your User Content in connection with operating and promoting the Services.

You remain responsible for your User Content.

6. Intellectual Property

All content on the Services, excluding User Content, including text, graphics, logos, designs, and software, is owned by or licensed to TownGuide and is protected by intellectual property laws.

You may not copy, modify, distribute, or exploit any part of the Services without our prior written consent.

The Services may include links to or integrations with third-party websites or services. TownGuide is not responsible for the content, policies, or practices of third parties, and your use of them is at your own risk.

8. Payments and Subscriptions

If you purchase paid features or subscriptions:

  • all fees are disclosed at the time of purchase;

  • payments are non-refundable unless otherwise stated; and

  • you agree to provide accurate billing information.

We may change pricing or offerings at any time with reasonable notice.

9. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services at our discretion, including if you violate these Terms or if we discontinue the Services.

Sections that by their nature should survive termination will continue to apply.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, TownGuide disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Services will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, TownGuide will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

Our total liability for any claim will not exceed the amount you paid to TownGuide in the twelve months prior to the claim, or zero if you have not paid us.

12. Indemnification

You agree to indemnify and hold harmless TownGuide and its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use your information.

14. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on the Services, and continued use after changes become effective constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction where TownGuide is established, without regard to conflict of law principles.
